Terms of Service

RFP is a business-to-business (B2B) platform built for companies operating in the gaming and interactive entertainment industry. The Platform helps studios, publishers, service providers, and buyers discover opportunities, connect with potential partners, submit proposals, manage project requirements, and build professional relationships.

The Platform is intended solely for commercial and professional use. By using RFP, you represent that you are acting on behalf of a business or for legitimate business purposes.

To improve visibility across the gaming industry, RFP maintains a directory that may include information gathered from publicly available sources, including company websites, public registries, industry databases, press releases, and other publicly accessible materials.

RFP does not claim ownership of any third-party company names, trademarks, logos, descriptions, or other publicly available business information displayed in the directory.

While we make reasonable efforts to keep directory information current, we cannot guarantee that all information will always be accurate, complete, or up to date. Directory listings are provided on an “as-is” basis.

If you are an authorized representative of a company listed in the directory, you may claim your company profile and request updates, corrections, management access, or removal of the listing. We reserve the right to verify your authority before granting control of a profile.

Unless otherwise stated, all content, software, functionality, design elements, and technology that make up the Platform are owned by or licensed to RFP and are protected by applicable intellectual property laws.

All third-party company names, product names, trademarks, service marks, logos, and brand assets displayed on the Platform remain the property of their respective owners.

Any reference to a third-party company, product, or service is provided for identification and informational purposes only. Such references do not imply endorsement, sponsorship, affiliation, partnership, or approval by the respective rights holder.

Certain features of the Platform require an account.

When creating an account, you agree to provide accurate, complete, and current information and to keep that information updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

We may suspend, restrict, or terminate accounts that provide false information, violate these Terms, engage in fraudulent activity, or otherwise create risk for the Platform or its users.

We may, but are not obligated to, verify the identity, legitimacy, or business status of any user, company, studio, publisher, buyer, or service provider using the Platform.

The Platform allows users to create project requests (“Tickets”) and submit responses or proposals (“Bids”).

Buyers may choose between public project postings and private or anonymous project postings designed to protect confidential projects and unreleased intellectual property. Information hidden through these privacy settings will remain concealed until the buyer chooses to disclose it.

RFP acts solely as a technology platform that facilitates introductions, discovery, and communication between businesses. RFP does not participate in negotiations, pricing discussions, project management decisions, contract execution, or project delivery.

Users are free to continue discussions, conduct due diligence, negotiate commercial terms, sign NDAs, execute contracts, and complete transactions outside the Platform.

RFP is not a party to any agreement entered into between users and assumes no responsibility for the performance, quality, legality, or outcome of any project, engagement, or business relationship formed through the Platform.

RFP operates as a subscription-based platform.

Unless otherwise stated, RFP does not charge transaction fees, commissions, success fees, or revenue-sharing fees on agreements entered into between users.

Any payment obligations arising from contracts between users are solely the responsibility of the parties involved. RFP is not responsible for collecting, processing, enforcing, or guaranteeing payments between users.

The Platform may provide reputation, review, verification, scoring, or feedback systems intended to help users evaluate potential business partners.

Users agree that any feedback, ratings, reviews, or project assessments they submit will be truthful, fair, and based on their actual experience.

We reserve the right to remove, moderate, or investigate feedback that we believe is fraudulent, abusive, misleading, defamatory, or otherwise inappropriate.

Reputation scores and reviews are provided for informational purposes only and should not be considered guarantees of future performance.

You agree not to:

• Use the Platform for any unlawful purpose.
• Misrepresent your identity, company, qualifications, or authority.
• Impersonate another individual, business, or organization.
• Upload, distribute, or transmit malicious code, viruses, malware, or other harmful technologies.
• Attempt to gain unauthorized access to the Platform, its systems, or other user accounts.
• Scrape, harvest, extract, or systematically collect Platform data without our prior written consent.
• Use the Platform to send spam, unsolicited commercial communications, mass marketing messages, or unrequested sales outreach.
• Interfere with the operation, security, or integrity of the Platform.
• Violate the intellectual property, privacy, confidentiality, or other rights of any third party.

The Platform may display content, company information, portfolios, profiles, reviews, proposals, and materials provided by users or obtained from public sources.

RFP does not endorse, verify, or guarantee the accuracy, quality, legality, ownership, or reliability of such content.

Any decision to engage with another user, company, studio, publisher, buyer, or service provider is made at your own risk.

You are solely responsible for conducting your own due diligence before entering into any business relationship or transaction.

The Platform is provided on an “as-is” and “as-available” basis.

To the fullest extent permitted by law, RFP disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, reliability, and uninterrupted operation.

We do not guarantee that the Platform will always be secure, error-free, available, or free from interruptions.

To the fullest extent permitted by applicable law, RFP, its operators, affiliates, contractors, service providers, and partners shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, business opportunities, goodwill, revenue, contracts, or data.

This limitation applies regardless of whether the claim arises from:

• Use of or inability to use the Platform;
• Inaccuracies in directory listings or public business information;
• User-generated content;
• Project delays, failures, disputes, or contractual breaches between users;
• Reliance on information, reviews, ratings, proposals, or communications provided through the Platform.

To the maximum extent permitted by law, RFP's total liability arising out of or relating to the Platform shall not exceed the total amount paid by you to RFP during the three (3) months preceding the event giving rise to the claim.

You agree to defend, indemnify, and hold harmless RFP, its operators, affiliates, contractors, employees, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising out of or relating to:

• Your use of the Platform;
• Your Tickets, Bids, submissions, content, or communications;
• Your violation of these Terms;
• Your violation of any law, regulation, intellectual property right, privacy right, or other third-party right.

We may suspend, restrict, or terminate your access to the Platform at any time if we reasonably believe that:

• You have violated these Terms;
• You present a security, legal, or operational risk;
• Continued access may harm the Platform, its users, or third parties.

Termination does not affect any rights or obligations that accrued prior to termination.

These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of Portugal, and you consent to the jurisdiction of those courts.

We may update these Terms from time to time.

When changes are made, we will update the Effective Date at the top of this page. Continued use of the Platform after revised Terms become effective constitutes acceptance of the updated Terms.
